1. Acceptance of Terms

By accessing or using GABAY ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

GABAY (Grading And Basic Academic sYstem) is a cloud-based school management system designed for Philippine K-12 schools. The Service includes features for attendance tracking, grading, enrollment management, DepEd school form generation, and other educational administration tools.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. School Administrator Responsibilities

School administrators who register their institution agree to:

  • Ensure all users from their school comply with these Terms
  • Obtain necessary consents for processing student and personnel data
  • Use the Service only for legitimate educational purposes
  • Maintain appropriate data protection measures within their organization

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share login credentials with unauthorized individuals
  • Attempt to gain unauthorized access to the Service or its systems
  • Upload malicious code or interfere with the Service's operation
  • Use the Service to harass, abuse, or harm others
  • Violate any applicable laws or regulations, including the Data Privacy Act of 2012

6. Data Ownership

Your school retains ownership of all data you input into the Service, including student records, attendance data, grades, and personnel information. GABAY does not claim ownership of your data.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will attempt to provide advance notice of scheduled maintenance when possible.

8. Subscription and Payment

Certain features of the Service may require a paid subscription. Payment terms, pricing, and billing cycles are specified in your subscription agreement. Failure to pay may result in suspension or termination of access to paid features.

9. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Service will be discontinued
  • You may request export of your data within 30 days of termination
  • We will delete your data in accordance with our data retention policies

10. Limitation of Liability

To the maximum extent permitted by law, GABAY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be resolved in the courts of the Philippines.
